2. Client Requirements
As a client, you agree to:
Provide accurate and timely information needed for project success
Cooperate with our team to move campaigns forward
Pay agreed-upon fees as outlined in your service agreement
Follow all platform rules (e.g., Meta, Google) when applicable
We are not liable for delays caused by a client’s lack of communication or missing materials.
3. Payments
Payment terms are established in each service agreement or invoice
All payments are due in full unless a payment plan is specified
Payments are non-refundable unless explicitly stated in writing
Late payments may result in service delays, paused campaigns, or cancellation
4. Intellectual Property
We retain ownership of all deliverables (ad copy, strategy, creative, etc.) until full payment is received. Upon full payment:
You are granted a license to use the materials for your business
We reserve the right to showcase non-confidential work in our portfolio
5. Confidentiality
Both parties agree to keep confidential information private and not share it with outside parties without written consent. This includes business data, strategies, and proprietary processes.
6. Results Disclaimer
Marketing results vary by industry, offer, audience, and timing. While we strive for strong performance, we do not guarantee specific results (e.g., sales, leads, return on ad spend). Your results may differ.
7. Third-Party Tools
We may use third-party tools and platforms (e.g., Meta Ads, Google Ads, Zapier) to deliver services. We are not responsible for changes, outages, or policy violations by these platforms.
8. Termination
Either party may terminate the agreement with written notice. Upon termination:
You are responsible for paying any outstanding fees
We will deliver all completed work owed to date
Any remaining balance will be billed immediately
9. Limitation of Liability
To the maximum extent permitted by law, My Momentum Marketing will not be liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount paid for the specific service in question.
10. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
11. Updates to These Terms
We may revise these Terms from time to time. The latest version will always be available on our website. Continued use of our services constitutes your acceptance of the revised Terms.
